2. Scope and applicable law
2.1 This privacy policy informs you about which personal data is collected, processed and used when using tribal.art.
2.2 Data processing is primarily carried out in accordance with the Swiss Federal Act on Data Protection (FADP). Where customers from the European Union or the United Kingdom are concerned, we also take into account the requirements of the General Data Protection Regulation (Regulation (EU) 2016/679, GDPR).
3. Hosting
This website is hosted by a provider based in Switzerland (Infomaniak Network SA, Geneva, Switzerland). When you access the website, the hosting provider automatically collects technical data and stores it in server log files (including IP address, date and time of access, page accessed, and browser used). This data is used for the technical provision and security of the website and is automatically deleted after a short period of time, unless there is a legal obligation to retain it.
4. Order processing (WooCommerce)
4.1 The online shop is operated using the WordPress extension WooCommerce. To process an order, we collect the following data: name, billing address and shipping address, email address, telephone number (if provided), ordered items, and order and payment details.
4.2 This data will be processed and stored exclusively for the purpose of fulfilling the purchase contract and complying with legal retention obligations.
5. Customer account
5.1 Customers can optionally create a customer account ("My Account"). In addition to the order data, a username and an encrypted password will be saved.
5.2 A customer account can be deleted at any time by contacting us, provided that there are no legal retention obligations to the contrary.
6. Payment processing (Stripe)
6.1 Zahlungen im Onlineshop sowie für weitere Leistungen von tribal.art werden über den Zahlungsdienstleister Stripe abgewickelt. Anbieter ist Stripe, Inc. mit Sitz in den USA sowie deren europäische Tochtergesellschaft Stripe Payments Europe, Ltd.
6.2 Im Rahmen der Zahlungsabwicklung werden die für die Zahlung erforderlichen Daten (unter anderem Name, Zahlungsmittelinformationen, Betrag) an Stripe übermittelt. Weitere Informationen finden sich in der Datenschutzerklärung von Stripe unter https://stripe.com/de/privacy.
6.3 Since Stripe partially transfers data to the USA, this is done on the basis of suitable safeguards, in particular standard contractual clauses of the European Commission or recognized transfer bases under Swiss data protection law.
7. Shipping
For the purpose of delivering the goods and tracking the shipment, we transmit the necessary address data (name, delivery address) to the respective transport company commissioned. Depending on the destination country, this may be a service provider based in Switzerland or within the European Union.
8. Cookies
8.1 This website uses technically necessary cookies, including those for the shopping cart and for logging into the customer account (session cookies and login cookies). These cookies are essential for the operation of the shop and cannot be deactivated without restricting its functionality.
8.2 No other cookies, not technically necessary, are currently being used.
9. Google Tag Manager
9.1 This website uses Google Tag Manager, a service provided by Google Ireland Limited. Google Tag Manager itself is a tool for managing website tags and does not set its own cookies. However, when the Google Tag Manager container loads, the visitor's IP address is transmitted to Google servers, which may be located outside of Switzerland and the European Union.
9.2 Currently, no other analytics or marketing tools (such as Google Analytics) are integrated via Google Tag Manager. Should this change, this privacy policy will be updated accordingly.
10th Newsletter
10.1 Sie können sich auf dieser Website für den Newsletter von tribal.art anmelden, im Footer oder im Formular zur Schätzung. Dafür benötigen wir Ihre Email Adresse. Nach der Anmeldung erhalten Sie eine Email, mit der Sie die Anmeldung bestätigen (Double Opt-in). Zeitpunkt der Anmeldung und der Bestätigung werden als Nachweis Ihrer Einwilligung gespeichert.
10.2 Der Newsletter informiert über Objekte, Auktionen und Beiträge von tribal.art. Die Verarbeitung erfolgt auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Sie können den Newsletter jederzeit über den Abmeldelink in jeder Email oder per Nachricht an info@jeandavid.com abbestellen.
10.3 Für den Versand nutzen wir den Newsletter Dienst der Infomaniak Network SA, Genf, Schweiz. Dabei wird erfasst, ob eine Email geöffnet und welche Links angeklickt wurden.
11. Making contact
When contacting us via email or a contact form, the data provided by the customer (including name, email address, content of the message) will be used and stored exclusively for processing the request, as long as this is necessary to answer the request and to fulfill any retention obligations.
12. Anfragen zur Schätzung
12.1 Über das Formular auf tribal.art/schaetzung können Sie uns Angaben und Fotos zu einem Objekt senden. Dabei verarbeiten wir Ihren Namen, Ihre Email Adresse, Ihre Telefonnummer (freiwillig) sowie Ihre Angaben zu Ihrem Anliegen und zum Objekt samt Fotos. Die Daten werden auf dieser Website gespeichert (siehe Ziffer 3) und an info@jeandavid.com weitergeleitet.
12.2 Wir verwenden die Daten, um Ihr Objekt einzuschätzen, Ihnen zu antworten und Ihnen gegebenenfalls weitere Leistungen anzubieten. Fotos und Angaben zum Objekt bewahren wir zudem zu Dokumentations und Vergleichszwecken auf. Eine Weitergabe an Dritte erfolgt nur nach Rücksprache mit Ihnen.
12.3 Mit dem Absenden des Formulars erklären Sie sich mit dieser Verwendung einverstanden. Soweit die DSGVO anwendbar ist, stützt sich die Bearbeitung Ihrer Anfrage auf Art. 6 Abs. 1 lit. b DSGVO und die Aufbewahrung zu Dokumentationszwecken auf unser berechtigtes Interesse (Art. 6 Abs. 1 lit. f DSGVO).
13. Speicherdauer
Personal data is stored only as long as necessary for the stated purposes or as required by law. Order and invoice data is subject to a ten-year retention period under commercial and tax law.
14. Rechte der betroffenen Personen
14.1 Betroffene Personen haben nach Massgabe des anwendbaren Rechts das Recht auf Auskunft über die zu ihrer Person gespeicherten Daten, auf Berichtigung unrichtiger Daten, auf Löschung sowie, soweit die Datenschutzgrundverordnung anwendbar ist, auf Einschränkung der Verarbeitung, auf Datenübertragbarkeit und auf Widerspruch gegen die Verarbeitung.
14.2 Zur Ausübung dieser Rechte genügt eine formlose Mitteilung an info@jeandavid.com.
15. Beschwerderecht
Data subjects may lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC). Where the General Data Protection Regulation (GDPR) is applicable, there is also a right to lodge a complaint with the competent supervisory authority in the respective country of residence.
16. Änderungen dieser Datenschutzerklärung
We reserve the right to amend this privacy policy to reflect changes in legal requirements or modifications to the services offered. The version valid at the time of each website visit shall apply.
